1. Teacher visitors to this Web Site must register in order to submit comments in response to News and Information items, in order to network with other registered Members, and in order to participate in online teacher surveys.

2. A registered Member (“Member” in the following) must indicate acceptance of the following General Terms and Conditions (hereinafter the "GTC").  These GTC shall govern the contract relationship between the Member and the Operator of this Web Site.

3. The Member warrants that he/she is a registered member in good standing with the Ontario College of Teachers (OCT).  The Operator shall verify same — and in the event of uncertainty, shall investigate in recognition that online impersonation of someone who is a member of OCT would constitute a criminal offense under section 403 of the Criminal Code of Canada. 

4. The Member warrants and represents that all of the data provided by the Member for registration are accurate and complete. The Member shall update any changes in the registration data without undue delay.  The Operator shall not disclose any data provided by the Member for registration to any third party (See Privacy Policy).

5. The Member shall choose a username and password upon registration.  The Member is obliged to keep this password secret. The Operator shall not disclose the password to any third party and the Operator shall not ask for the Member's password at any time.

6. By completing the registration process, the Member consents to enter the agreement to use the services of the Web Site. The Operator accepts this offer by activating the membership for the use of services on the Web Site. The agreement takes effect with the aforementioned acceptance by the Operator.

7. Each Member is entitled to register only once, and the Member may establish only one (1) username within one Member profile.

8. The Member is obliged to provide only true and non-misleading statements in submitted comments and in communications with other Members.

9. All comment postings and Forum discussion submissions by the Member must be written in a constructive and professional manner—respectful of others and free of offensive, slanderous, or illegal content.  All postings and submissions will be vetted by the site Operator (moderator), and those that do not meet the above criteria will be removed from posting, or remain unposted.  

10. Members may choose to remain anonymous in Comment postings if they wish, and to be identifited only by username.  If anonymity is preferred, it is recommended that the content of the posting be free of information that could reveal the identity of the Member author and all persons and places connected with the Member author—and including the names of the locations (e.g. cities) where they reside, or have resided, and the names of the schools, districts or boards where they are, or have been, employed.   

11. Members may also choose to remain anonymous in General Discussions within the Members' Forum area — accessible only to Members (see Privacy Policy). 

12.  The Operator does not make any warranties or representations regarding any information provided or made available by any Member on the Web Site, or on any external web sites linked to the Web Site.  In particlar, the Operator does not warrant or represent that said information is true or accurate, or that it fulfils or serves any particular purpose.

13. The Operator warrants that the material made available on the Web Site does not necessarily represent the policies of ETFO, OSSTF/FEESO, OECTA, OPC, CPCO, OPSBA, OCT, or Ontario Ministry of Education — and that the views expressed in comment posts and in the discussion Forum on the Web Site are the views of the individual Member authors of these commentaries and discussions, and do not necessarily represent the views of the Operator or Ontario Teachers Network.

14. The Operator may send notices or other communication to the Member by email using the email address provided during Member registration.  The Member may send email communication to the Operator using the Contact link on the Web Site.

15. Any use of the contents offered on the Web Site beyond the scope of options provided by the Operator requires the prior written consent of the Operator.

16. The Operator merely provides the Member with a platform on which to post commentaries, participate in the discussion Forum, and to establish contact with other Members, and only provides those technical applications that allow Members to contact one another (see Privacy Policy).  If Members enter into agreements with one another over the Web Site, the Operator shall not be a contracting party to these agreements.  The Members alone are responsible for the execution and/or fulfilment of agreements in which they enter with one another. The Operator shall not be held liable if Members are unable to contact one another over the Web Site regarding such agreements. Furthermore, the Operator shall not be liable for breaches of duty in relation to agreements entered into between Members.

17. The Member shall indemnify and exempt the Operator from all actions, including damage claims, asserted by other Members or third parties against the Operator resulting from an infringement of their rights by the contents posted by the Member on the Web Site. Furthermore, the Member shall indemnify and exempt the Operator from all actions, including damage claims, asserted by other Members or third parties against the Operator resulting from an infringement of their rights regarding the use of the services on the Web Site by the Member. The Member assumes all reasonable costs the Operator incurs due to an infringement of third party rights, including all reasonable legal-defense costs. All other rights, including damage claims by the Operator, are hereby unaffected. The aforementioned obligations shall not apply to the extent the Member is not responsible for the infringement.

18. In the event the contents posted by the Member infringes any rights of any third party, the Member shall, at his/her own expense and at the Operator's discretion, either obtain the right to use said contents or render said contents free of any infringement.  In the event the Member infringes third-party rights when using the services of the Web Site, the Member shall discontinue such use that violates these GTC and the law, if so requested by the Operator.

19. The Member may report any activities of any other Member which violate applicable laws and/or any of the terms and conditions of these GTC using the Contact link on the Web Site.

20. The Member acknowledges and agrees that it is technically impossible to achieve 100% availability of the Web Site.  The Operator shall nonetheless endeavour to keep the Web Site available without interruption.  Events related to maintenance, security or capacity requirements, and/or events beyond the Operator's control (e.g. disruptions in public communication networks, power failures etc.), may result in brief malfunctions or temporary interruptions of the services provided on the Web Site.

21. The Operator reserves the right to modify the services offered on the Web Site and/or to offer services different from those offered at the time of the Member's registration at any time.

22. The Operator reserves the right to amend these GTC at any time, without giving reasons, unless an amendment is unreasonable to the Member.
